Introduction

This document refers to personal data, which is defined as information concerning any living person (a natural person who hereafter will be called the Data Subject) that is not already in the public domain.

The General Data Protection Regulation (GDPR) seeks to protect and enhance the rights of data subjects. These rights cover the safeguarding of personal data, protection against the unlawful processing of personal data and the unrestricted movement of personal data within the EU. Data Processing

Fresh Air Fitness collects and processes customer information in pursuance of its business activities and in this capacity is termed a ‘data processor’ in GDPR regulatory terms. When working exclusively as a data processor, Fresh Air Fitness will be acting on the instruction of its customer, and will work hard to ensure that the customer is fully GDPR compliant.

For customers who are representing a business or organisation, we do not require your consent to opt into receiving continued communications but you can opt out of the same by emailing DPL@freshairfitness.co.uk or writing to us, see last section for full contact details.  Our processing activities are limited to those activities described in this document.

For customers who are not representing a business, we will not send unsolicited marketing material or emails to you.  We shall respond to any initial queries but we will not send follow up emails to you unless in response to any further request from you.  We shall only initiate contact once your intent is clear to enter into contractual negotiations.

Personal Data

Fresh Air Fitness uses the information supplied by you to provide quotations, make telephone contact following any request for information and fulfil order contracts. If you represent a business or organization we may occasionally email you marketing information, which Fresh Air Fitness believes may be of interest to you and your business interests but you can opt out of receiving this at any time.

In you making initial contact you are entering a dialogue with Fresh Air Fitness with a view to entering into, or considering whether to enter into, a sales contract with us.  This dialogue will continue until you either opt out (which you can do at any stage).  However, should we not receive any inbound contact from you over a period of 12 months, your account will become inactive and we will not contact you again unless you so request.

Some personal data may be collected about you from the forms and surveys you complete, or from records of our correspondence and phone calls and details of your requests via our website, including but not limited to personally identifying information like Internet Protocol (IP) addresses. Google Enhanced Conversions 

If you complete a conversion on our website, we may receive your email address, name, address and/or phone number. This data can be captured in our conversion tracking tags, hashed, sent to Google in its hashed form and then used to enhance our conversion measurement which tells us how many enquiries become customers.

The hashed data will be used in the following ways to improve our measurement:

To improve measurement of online conversions. Allows us to send hashed customer data from our website.  This data is then used to match Google accounts which were signed-in to when you engage with one of our advertisements so that Google can identify 

 This allows us to recover conversions that otherwise wouldn’t have been measured and improve bidding optimisation.

  • To meet Fresh Air Fitness’s contractual obligations to customers and to provide potential customers with information required for the proper consideration of a contractual agreement. 
  • To provide information regarding products and services to individuals representing businesses or organisations whom Fresh Air Fitness legitimately believes would be interested in the products and services offered and to respond to marketing or sales enquiries made by private individuals. 
  • To fulfil sales orders, including the administration of the warranty on goods sold.

To promote and market the products and services offered by Fresh Air Fitness to potential customers who are active in the sectors typically catered for by Fresh Air Fitness.

Disclosure

Fresh Air Fitness may on occasions, and only as part of the process of fulfilling orders or supplying services, be required to pass personal Information of customers, or their agents or actors, to its suppliers or agents. In these cases, only a telephone number and business title will be disclosed in order to protect the personal identity of the individual involved.  Fresh Air Fitness requires relevant suppliers and agents to agree to process this information based on our instructions and in line with requirements of this Privacy Notice and GDPR.

Fresh Air Fitness do not broker or pass on information without your consent. However, Fresh Air Fitness may disclose your Personal Information to meet legal obligations, regulations or valid governmental request. Fresh Air Fitness may also enforce its Terms and Conditions, including investigating potential violations of its Terms and Conditions to detect, prevent or mitigate fraud or security or technical issues; or to protect against imminent harm to the rights, property or safety of Fresh Air Fitness, its customers and/or the wider community.

Retention Policy

Fresh Air Fitness will process personal data during the duration of any contract and will continue to store only the personal data needed for five years after the contract has expired to meet any legal obligations. After five years any personal data not needed will be deleted.  Some data is required to be held throughout the period of the warranty of goods sold.  This will be limited to key account holder information agreed with you upon fulfilment of any order and you should inform us should these details change.

Data storage

Data is held in the UK using different (multiple) servers. Fresh Air Fitness does not store personal data outside the EEA.

Your rights as a data subject

At any point whilst Fresh Air Fitness is in possession of or processing your personal data, all data subjects have the following rights:

  • Right of access – you have the right to request a copy of the information that we hold about you.
  • Right of rectification – you have a right to correct data that we hold about you that is inaccurate or incomplete.
  • Right to be forgotten – in certain circumstances you can ask for the data we hold about you to be erased from our records.
  • Right to restriction of processing – where certain conditions apply you have a right to restrict the processing.
  • Right of portability – you have the right to have the data we hold about you transferred to another organisation.
  • Right to object – you have the right to object to certain types of processing such as direct marketing.
  • Right to object to automated processing, including profiling – you also have the right not to be subject to the legal effects of automated processing or profiling.

In the event that Fresh Air Fitness refuses your request under rights of access, we will provide you with a reason as to why, which you have the right to legally challenge.

Fresh Air Fitness at your request can confirm what information it holds about you and how it is processed

  • Identity and the contact details of the person or organisation (Fresh Air Fitness) that has determined how and why to process your data.

  • The purpose of the processing as well as the legal basis for processing.
  • If the processing is based on the legitimate interests of Fresh Air Fitness or a third party such as one of its customers, information about those interests.

  • Recipient(s) or categories of recipients that the data is/will be disclosed to.
  • How long the data will be stored.
  • Details of your rights to correct, erase, restrict or object to such processing.
  • Information about your right to withdraw consent at any time.
  • How to lodge a complaint with the supervisory authority (Data Protection Regulator).
  • Whether the provision of personal data is a statutory or contractual requirement, or a requirement necessary to enter into a contract, as well as whether you are obliged to provide the personal data and the possible consequences of failing to provide such data.
  • The source of personal data if it wasn’t collected directly from you.
  • Any details and information of automated decision making, such as profiling, and any meaningful information about the logic involved, as well as the significance and expected consequences of such processing.

To access what personal data is held, identification will be required

Fresh Air Fitness will accept the following forms of ID when information on your personal data is requested: a copy of your national ID card, driving license, passport, birth certificate and a utility bill not older than three months. A minimum of one piece of photographic ID listed above and a supporting document is required. If Fresh Air Fitness is dissatisfied with the quality, further information may be sought before personal data can be released.

Complaints

In the event that you wish to make a compliant about how your personal data is being processed by Fresh Air Fitness or its partners, you have the right to complain to Fresh Air Fitness’ MD. If you do not get a response within 30 days you can complain to the Data Protection Regulator.
